These Terms and Conditions set out the basis on which Waste Clearance Richmond provides rubbish removal and waste collection services to domestic and commercial customers. By making a booking, accepting a quotation, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business, company, partnership, organisation or other entity that requests and/or receives waste clearance services from Waste Clearance Richmond.
Services means any waste collection, rubbish removal, clearance, loading, transportation, or related services provided by Waste Clearance Richmond.
Waste means any items, materials, junk, refuse or goods requested by the Customer to be collected and removed, excluding any prohibited or hazardous items as defined in these Terms and Conditions.
Quotation means the price or pricing structure given to the Customer for the Services, whether stated verbally, in writing, by email, messaging, or any other agreed communication method.
Waste Clearance Richmond provides waste collection and clearance services for a range of domestic and commercial needs. This may include, but is not limited to, household rubbish, garden waste, office items, light construction debris, and general non-hazardous waste. All Services are carried out subject to applicable waste management and environmental regulations in the United Kingdom.
We reserve the right to refuse to collect items that we reasonably believe to be hazardous, illegal, excessively heavy or otherwise unsuitable for manual loading and transport using our standard vehicles and equipment. This may include, without limitation, certain chemicals, asbestos, medical waste, gas cylinders, pressurised containers, and materials requiring specialist handling or licensing.
3.1 Bookings may be made by telephone, email or through any booking facility operated by Waste Clearance Richmond. The Customer is responsible for providing accurate and complete information about the type and approximate volume or weight of Waste, access arrangements, parking availability, and any special circumstances relevant to the job.
3.2 Any Quotation provided prior to our arrival is based on the information supplied by the Customer and is therefore an estimate only. The final price may be adjusted if, on arrival, the actual volume, weight, nature or location of the Waste differs from that described. In such cases, we will inform the Customer of any revised price before work begins.
3.3 A booking is not confirmed until we have accepted it and provided a booking confirmation. We reserve the right to decline or cancel a booking at our discretion, including where the Waste falls outside our standard service capabilities or where safe access cannot be guaranteed.
3.4 The Customer must ensure that an authorised person is present at the property at the scheduled time of collection to confirm the items to be removed and to approve any necessary adjustments to the Quotation.
4.1 The Customer must ensure that our operatives have safe, reasonable and lawful access to the Waste at the agreed time. This includes ensuring that doors, gates and entry points are unlocked and clear, and that any security, concierge or building management requirements are addressed in advance.
4.2 The Customer is responsible for arranging suitable parking for our vehicle as near as reasonably possible to the property, and for covering any parking charges or permits that may apply. If our team incurs parking fines or penalty charges as a direct result of following the Customer’s instructions, the Customer will be liable for those charges.
4.3 If poor access, restricted entry, or lack of parking significantly affects our ability to carry out the job safely or efficiently, we may cancel or postpone the job and may charge the Customer a call-out or wasted journey fee.
5.1 The Customer must ensure that any Waste intended for collection is clearly identified and separated from items that are not to be removed. We will not be liable for items taken away in error where the Customer has failed to adequately distinguish them from the Waste.
5.2 The Customer warrants that they either own the Waste or are authorised by the owner to request its removal. The Customer agrees to indemnify Waste Clearance Richmond against any claims arising from the removal of items where adequate authority was not held.
5.3 The Customer must notify us in advance of any items that may reasonably require special handling, heavy lifting or dismantling, and accepts that additional charges may apply in such circumstances.
6.1 Our pricing generally reflects the volume or weight of Waste, the type of materials, labour time, access difficulty, and any disposal or recycling costs imposed by waste facilities and regulations. All prices are quoted in pounds sterling and, unless expressly stated, are exclusive of VAT where applicable.
6.2 Quotations are provided in good faith based on the information supplied and, unless otherwise indicated, are valid for 30 days. We reserve the right to amend a Quotation if costs change due to factors beyond our control, such as changes in disposal charges or regulatory requirements.
6.3 If the Customer requests additional work or an extension of the Services on the day of collection, we may agree to undertake this at our discretion and will confirm any extra charges before proceeding.
7.1 Payment is due on completion of the Services unless alternative terms have been agreed in writing in advance. We may accept payment by cash, bank transfer, card, or other methods as notified to the Customer at the time of booking or completion.
7.2 For commercial Customers, credit terms may be offered at our discretion. Where credit terms apply, payment must be made in full within the period stated on the invoice. We reserve the right to charge interest on overdue invoices at the statutory rate permitted under UK law, together with any reasonable costs incurred in recovering the debt.
7.3 We may require a deposit or full advance payment to secure certain bookings, particularly larger clearances, multi-day projects or work taking place outside normal hours. Deposits are non-refundable in the event of late cancellation unless otherwise stated in these Terms and Conditions.
7.4 We reserve the right to withhold or suspend Services if payment is not received in accordance with the agreed terms or if we have reasonable grounds to believe that the Customer is unable or unwilling to pay.
8.1 The Customer may cancel or amend a booking by providing us with notice by telephone or email. Any cancellation or amendment must be acknowledged by us to be effective.
8.2 If the Customer cancels more than 24 hours before the scheduled arrival time, any deposit paid may be refunded or transferred to a future booking at our discretion, subject to any non-recoverable costs already incurred.
8.3 If the Customer cancels less than 24 hours before the scheduled arrival time, or if our team arrives on site and is unable to carry out the job due to reasons within the Customer’s control, we may charge a cancellation or wasted journey fee, which may include a portion or all of the quoted service charge.
8.4 Where we are unable to attend due to circumstances beyond our reasonable control, including severe weather, vehicle breakdown, accident, or unforeseen staff shortages, we will notify the Customer as soon as practicable and rearrange the appointment. We will not be liable for any loss arising from such delays or rearrangements, but any deposits will be carried forward or refunded if the Customer chooses not to rebook.
9.1 Waste Clearance Richmond operates in accordance with relevant UK waste management and environmental legislation. We will transport and dispose of Waste only at authorised facilities and in line with applicable duty of care requirements.
9.2 The Customer agrees not to present any prohibited or hazardous materials as part of the Waste unless we have expressly agreed in writing to handle such materials and hold the necessary authorisations. Prohibited materials may include, but are not limited to, asbestos, certain chemicals, solvents, oils, clinical or medical waste, explosives, firearms, and any substances classified as hazardous under current regulations.
9.3 If hazardous or prohibited materials are discovered amongst the Waste, we may refuse to remove them, may adjust the price to reflect any additional handling and disposal costs, and may, if necessary, terminate the Services immediately. The Customer will be responsible for any costs, penalties, or liabilities arising from their failure to disclose such materials.
9.4 We may provide documentation such as waste transfer notes on request, recording the movement and nature of the Waste in accordance with regulatory requirements.
10.1 Waste Clearance Richmond will exercise reasonable care and skill in providing the Services. However, the Customer accepts that some risk of minor scuffs or marks may exist where Waste is removed from tight spaces, stairways, or narrow access points.
10.2 We will not be liable for any pre-existing damage to property or items, or for deterioration of items that are inherently fragile, poorly constructed, or already in a compromised condition. The Customer is responsible for protecting floors, walls, and fixtures where necessary, and for moving fragile or valuable objects out of harm’s way.
10.3 Our total liability to the Customer for any loss or damage arising out of or in connection with the Services, whether in contract, tort, negligence or otherwise, shall be limited to the total price paid or payable for the specific job giving rise to the claim, except where such limitation is prohibited by law.
10.4 Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
10.5 We will not be responsible for any indirect or consequential loss, including loss of profits, business interruption, or loss of opportunity, arising out of or in connection with the provision or non-provision of the Services.
11.1 If the Customer is dissatisfied with any aspect of the Services, they must notify us as soon as reasonably practicable and, in any event, within 48 hours of completion of the job. We may request supporting information, including photographs, to help assess the issue.
11.2 We will review any complaint in good faith and, where appropriate, may offer to rectify the matter, provide a partial refund, or take other reasonable steps to resolve the issue. Any such resolution will be at our discretion and subject to the limitations of liability set out in these Terms and Conditions.
12.1 Waste Clearance Richmond maintains insurance cover appropriate to the nature of its Services, including public liability insurance. This insurance is intended to provide a level of protection in the unlikely event of certain accidental incidents occurring during the execution of the Services.
12.2 It remains the Customer’s responsibility to maintain adequate insurance for their own property and belongings. Our insurance does not replace the need for contents or buildings insurance held by the Customer.
13.1 In the course of providing Services, we may collect and process personal data relating to the Customer, such as contact details, service addresses, and billing information. We will handle such data in accordance with applicable UK data protection laws.
13.2 Personal data will be used only for legitimate business purposes, including managing bookings, delivering Services, processing payments, and handling queries or complaints. We will retain data only for as long as necessary to fulfil these purposes or to satisfy legal and regulatory obligations.
14.1 Waste Clearance Richmond reserves the right to amend these Terms and Conditions from time to time. Any updated version will apply to new bookings made after the date on which the revised terms are published or otherwise communicated to Customers.
14.2 For ongoing or long-term service arrangements, we will notify the Customer of any material changes to these Terms and Conditions and, where required, seek their acceptance of the revised terms.
15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Waste Clearance Richmond.
16.1 If any provision of these Terms and Conditions is found by any court or competent authority to be invalid, unlawful, or unenforceable, such provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
17.1 These Terms and Conditions, together with any written Quotation or service agreement issued by Waste Clearance Richmond, constitute the entire agreement between the parties in relation to the Services and supersede any prior understandings or arrangements, whether oral or written.
17.2 The Customer acknowledges that they have not relied on any statement, promise or representation not expressly set out in these Terms and Conditions or in an agreed written document.
